What the condo documents say

We read the Boardman Flats master deed and condominium bylaws, recorded December 22, 2023, and the association’s corporate bylaws. The developer was 619 Boardman Flats LLC.

The master deed calls it a conversion condominium of a building that has operated as an apartment building since 2017.

  • Rentals

The documents say units may be rented on a transient basis and that no restriction should be read to limit that. Subject to applicable laws, owners have the right to lease, including on a transient basis. The City of Traverse City has its own short-term rental rules, which the association documents don’t replace.Source: Condominium Bylaws, Articles VI and VII

  • Pets

Household pets are allowed, with a limit of two dogs older than four months per owner, and the board can remove a pet whose conduct it finds objectionable.Source: Bylaws, Article VI

  • Zoning

The master deed warns that the units may be nonconforming uses under current zoning and may not be modified, enlarged, changed or rebuilt after destruction without city approval.Source: Master Deed

  • Reserves and special assessments

The reserve fund must be at least 10 percent of the annual budget. The board can levy assessments for replacements and emergencies on its own; other special assessments need prior approval of more than 60 percent of all owners, in value and in number.Source: Bylaws, Article II

  • Paid at closing on a resale

The board can require a resale buyer to pay up to two months of regular assessments into reserves at closing, by written notice.Source: Bylaws, Article II

  • Rules to know

Units are single-family residential use only. No exterior changes, white window liners only, no signs other than the developer’s while it owns a unit, and no storage or unattended bikes in common areas.Source: Bylaws, Article VI

Buying here: what to check

Boardman Flats sells mostly small one-bedroom units near downtown Traverse City. These are the things we check before an offer.

No budget was in the documents we read. Ask for it, and for the reserve balance.
